Prof. Dr. H. Burak Gemalmaz

Prof. Dr. H. Burak Gemalmaz has been serving as a faculty member at Istanbul University Faculty of Law, one of Turkey’s leading law faculties, since 2009. He pioneered the establishment of the Department of Human Rights Law at Istanbul University Faculty of Law and currently serves as the head of this department. Professor Gemalmaz also holds the position of Director at the Istanbul University Center for Human Rights Law Practice and Research. Approaching human rights with an innovative perspective, Professor Gemalmaz conducts various projects within the Center, focusing on issues previously unexplored within the scope of human rights, considering that human rights law introduces applicable principles, rules, and standards to all legal disciplines and intertwines with other legal disciplines and fields.

Within the scope of the “3005 – Innovative Solutions Research Projects in Social and Human Sciences” supported by TÜBİTAK (The Scientific and Technological Research Council of Turkey), the project titled “Obligation of Companies to Respect Human Rights” aims to increase awareness of human rights among companies operating in Turkey, ensure their adoption of responsibilities to respect human rights, prevent and mitigate negative impacts on human rights and violations thereof arising from activities related to work and trade, develop solutions, and ultimately align their activities with human rights. One of the projects contributing to the enhancement of compliance with human rights law in Turkey and the incorporation of human rights into all areas of law, carried out in collaboration with the Beşiktaş Lawyers Association, is the project titled “Ensuring Respect for the Rights of Away Team Supporters in Football Away Matches” (Observer Lawyers Project), investigating human rights violations experienced by away team supporters during entry and exit from stadiums, during matches inside stadiums, and in the vicinity of stadiums after matches.

At Istanbul University Faculty of Law, Professor Gemalmaz teaches undergraduate courses in General Public Law, Human Rights Law, Political Science, and Animal Protection Law, as well as graduate-level courses on “Protection of Property in ECtHR Decisions,” “ECtHR and Turkish Constitutional Court Practices Regarding Real Estate Law,” and “Effectiveness of Individual Application to the Turkish Constitutional Court.” He has previously taught courses at the undergraduate, graduate, and doctoral levels on topics such as “The Role of Human Rights in ICSID Decisions,” “Protection of Foreign Investors by the ECtHR,” “Protection of Human Rights in the European Union,” “Environmental Law,” and “Economic, Social, and Cultural Rights.”

Professor Dr. H. Burak Gemalmaz is the author of books including “Effectiveness of Individual Application to the Turkish Constitutional Court,” “Fundamental Principles of Individual Application to the Constitutional Court and Decisions Regarding Labor and Social Security Law,” “Power and Freedom in Virtual Worlds,” “Handbook on Property Rights in Individual Applications,” and “Property Rights in the European Convention on Human Rights.” His book titled “Property Rights in the European Convention on Human Rights” earned him the “Young Lawyer of the Year (2008)” award from the Turkish Industry and Business Association (TÜSİAD) in 2009. Additionally, he has published numerous articles and papers on these topics in national and international journals.

Furthermore, Professor Dr. H. Burak Gemalmaz continues his work in sports law. His article titled “Applicability of Human Rights Standards in Turkish Football Arbitration: the Contribution of the European Court of Human Rights” was published in the 2019 issue of The International Sports Law Journal, one of the world’s leading sports law journals. He continues to deliver various lectures and seminars on sports law within the framework of the Sports Studies Center and the Private Law Graduate Program at Kadir Has University. Gemalmaz also provides training within the Istanbul Bar Association Sports Law Commission and engages in various activities, including organizing conferences.

In addition to his academic work, Gemalmaz has practical experience in his areas of expertise. He provides consultancy services to national and international judicial bodies and continues to provide training to practitioners in his areas of expertise. In this context, he has prepared training materials and provided training to hundreds of judges and lawyers within the framework of projects such as the European Union and Council of Europe’s “Joint Project for Increasing the Effectiveness of Administrative Justice and Strengthening the Institutional Capacity of the Council of State,” “Joint Project for Supporting the Individual Application System to the Constitutional Court,” “Joint Project for Supporting the Effective Implementation of the Constitutional Court’s Decisions in the Field of Fundamental Rights,” and “Joint Project for Strengthening the Capacity of Bar Associations and Lawyers in European Human Rights Standards.” Gemalmaz has also played an active role in bringing numerous disputes before the ECtHR and the Turkish Constitutional Court and in the formulation of jurisprudential decisions.
